Terms & Conditions

Individual and Group Booking and Cancellation

Upon the acceptance of a booking, the White Hart Hotel will require a deposit of £50.00 or a credit card number in order to retain the room.

The deposit is non-refundable except in the case of cancellation by the Hotel for the reasons contained in clause 1.7.

Acceptance of a booking, whether verbally or in writing, followed by the payment of a deposit creates a legally binding contract between the Hotel and the person from whom the booking has been accepted (the Guest).

The number of people occupying a room must not exceed the maximum number stated.

In the event of a late cancellation of any booking or non-arrival by the Guest, the Guest shall pay to the Hotel a cancellation fee. A late cancellation is one which has been communicated to the Hotel less than 48 hours prior to the date of the first nights accommodation. This must be done by midday, 48 hours prior to arrival. Christmas and New Year reservations will require a cancellation 7 days prior to arrival and a £50.00 per room deposit.

The Hotel shall endeavour to re-let the accommodation but failing this, the cancellation fee shall be equivalent to 100% of the total cost of the accommodation element of the booking except where this was calculated on a discounted or package basis in which case the cancellation fee will be 100% of the normal room rate multiplied by the number of nights of the booking.

The Hotel reserves the right to cancel a booking forthwith and without liability on its part in the event of damage or destruction to the Hotel by fire or other causes, any shortage of labour or food supplies, or any other cause beyond the control of the hotel which shall prevent it from performing its obligations in connection with any booking. In such an event the Hotel will refund the deposit made but will have no further liability to the Guest.

[Where the Guest gives credit card details to the Hotel in order to guarantee a booking or in order to make payment of a deposit then it is agreed between the parties that in the event of cancellation the Hotel may debit the Guest’s credit card with the full amount of the cancellation charge as set out in clause 1.6 less an allowance for any deposit or payment already received.]

Payment

Payment of the bill for accommodation and food and other services shall be made prior to departure from the Hotel.

Occupancy

Occupancy shall be from 2 p.m. on the day of arrival to 11 a.m. on the day of departure, unless special arrangements have been agreed in advance.

Prices

All prices for accommodation, food and beverages are stated in pounds sterling and include VAT.

All price increases resulting from Government regulations or legislation or local taxes or charges will be re-charged to the Guest.

Loss of or damage to Guest’s Property

The Hotel does not accept responsibility for loss of or damage to any cash, money, jewellery or other articles of value unless they are deposited at the Reception Office for safe keeping [and a note of deposit is handed to the Guest by the recipient. The note of deposit must be presented by the Guest in the event of a claim].

In the event of negligence on the part of the Hotel which gives rise to loss of or damage to property belonging to a Guest the Hotel’s limit of liability will be limited to £50 for any single article and subject to a total of £100 in the case of any one Guest. No liability is accepted for any consequential loss arising from loss or damage to property of the Guest.

The Hotel does not accept responsibility for loss of or damage to motor cars or other vehicles of any kind, or any property lost in them; or horses or other live animals including pets.

The Hotel refers to and relies upon The Hotel Proprietors Act 1956.

Loss from or damage to Hotel Property

Guests shall indemnify the Hotel for any loss from or damage to the Hotel or the furnishings and equipment therein caused by the wilful act or default of the Guest or persons or animals within their control.

The Guest shall pay to the Hotel on demand the amount required to make good or remedy the damage, or replace any items missing from the Hotel.

If in the opinion of the Hotel the Guest or anyone staying with the Guest is not suitable to continue their occupation because of unreasonable behaviour, damage or nuisance to other parties, the Hotel is entitled to treat the contract as at an end and the Guest may be asked to vacate their room. The Guest will remain liable for the whole cost of the booking and no refund shall be due.

Complaints

If the Guest has a complaint concerning any aspect of the services provided by the Hotel then it is the duty of the Guest to inform the Hotel immediately, or as soon as is reasonably practicable and in any event before the termination of the stay.

It is specifically agreed between the parties that failure by the Guest to notify the Hotel of any complaints in accordance with the timescale set out in clause 7.1 will entitle the Hotel to refuse to entertain the complaint, irrespective of the merits of the complaints.

No Smoking Policy

The hotel operates a strict no smoking policy in designated areas of the hotel. This policy specifically extends to non-smoking rooms and public areas.

Guests are politely asked not to smoke in any designated non-smoking areas and the hotel reserves the right to terminate this contract and ask guests that continue to disregard this policy to leave the premises.

Without prejudice to the aforementioned the guest, when entering into this contract, specifically accepts liability for any damage caused to persons or property through smoking in non-smoking areas, or through wilful or negligent action or omission in designated smoking areas.

General Points

The Guest shall not arrange for the delivery of or deliver any goods or materials to the Hotel without prior arrangement with the Hotel.

The guest shall not store or place on the perimeter of or in the hotel any inflammable, combustible or objectionable substances or liquid.

The Hotel does not allow food or drink other than that purchased on the premises to be consumed unless by prior arrangement.

Waiver

The failure of the Hotel to enforce or exercise, at any time, or for any period of time, any term of, or any right pursuant to this Agreement does not constitute and shall not be construed as a waiver of such term or right.

Legal Provision

The construction, validity and performance of this Agreement is governed by the law of England and the parties submit to the jurisdiction of the English Courts.

The Guest agrees that the Contract with the Hotel is made at the Hotel’s premises and that any proceedings between the parties shall be conducted in the County Court nearest to the Hotel.

Clause Headings

DEPOSITS.

1. Where the agent / operator has no credit arrangement with The White Hart Hotel / The Ancient Gate House Hotel, a deposit of 50% of the gross value of the total allocation is required eightweeks prior to arrival.Full payment will be required 7 days prior to arrival.

2.Where credit terms have been agreed, the agent / operator will be invoiced by the hotels for the full outstanding balance after departure.This is to be paid within 14 days of receipt of invoice.In all cases, the agent / operator will present a voucher to cover the terms.

PAYMENT.

Payment should be made by Bank Swift Code or credit card, 8 weeks prior to arrival.

No other form of payment will be accepted.

RELEASES.

Once the provisional booking has been confirmed, the rooming list will be sent direct to the hotel 28 days prior to arrival.Any rooms not taken will automatically be released by the hotel, and, if subsequently required, will have to be re-booked by the agent / operator on a request basis.

CANCELLATIONS.

Cancellation of bookings can be very costly for a hotel.Cancellation made over 56 days prior to arrival will not incur a charge.Cancellations made less than 56 days prior to arrival will incur a cancellation charge on the full gross value of the booking as follows :

31 – 56 days :50%

less than 31 days :100%

GROUP NUMBERS.

1.If the hotel is given at least 14 days notice, group numbers can be reduced by up to 15% without charge.Reductions of over 15% will incur the charges detailed above, which will apply pro-rata.

2.If the hotel is given less than 14 days notice, group numbers can be reduced by up to 5% without charge.Anything over 5% will be charged at the agreed per guest rate.

3.It is the responsibility of the agent / operator to notify the hotel on a monthly basis of the number of rooms required, as of 6 months prior to arrival.

CHRISTMAS / SPECIAL EVENTS.

Cancellation of a group booking of such an event with less than 4 months notice will incur full charge.
